License grant

By submitting your Manuscript (further referred as “Work”) into Actavia You agree with the followitg Statement and enter into Licensing Agreement with following terms and conditions with Palacký University Olomouc (further referred as “PUOL”):

1. Author´s statement

1.1The author declares that the Work is free of copyright or other legal defects, it was neither published anywhere else, nor simultaneously offered for publication, except the platforms of standard scientific pre-submission communications (e.g. SSRN, ResearchGate).

1.2 The author declares that he/she is the real author or the joint author of the Work and his/her freedom to grant the license is not limited or excluded, and the author is entitled to dispose of the Work, because especially, but not limited to:

The Work is not an Employee work where the employee would not be entitled to exercise the rights to the Work,
Using of the Work within the scope of the granted license is not limited by the conditions of provided grant or other financial support (e.g. GAČR - Czech Science Foundation, TAČR - Technology Agency of the Czech Republic),
Using of the Work within the scope of the granted license is not limited by the third parties’ rights (e.g. copyright, the right to the protection of personal data),
The Work is not the work of joint authors, where the other joint authors would not agree to grant the license.

1.3 In the case that the Work is the work of joint authors, the author declares that all the joint authors have been informed of these License Terms and that he/she is authorized to grant PUOL the license under these License Terms on behalf of the joint authors.

1.4 The author agrees that if the Work is accepted for publication, the proposal to conclude a licensing agreement for the Work will be on his/her behalf aimed at an indefinite number of persons, while the content of the agreement will be determined by reference to the publicly available licence conditions Creative Commons BY-SA 4.0 International or Creative Commons BY 4.0 International (depends on the Journal's choice). Such proposal will not be done for the works or the elements (e.g. image or photographic documentation) used by the author in the Work under a contractual license with a third party.

1.5 Terms and conditions of Creative Commons Attribution-ShareAlike 4.0 International Public License (“Public License”) are available from: https://creativecommons.org/licenses/by-sa/4.0/legalcode.

1.6 If any of the author’s statements prove to be untrue, the author is aware that he/she is liable for the resulting damage, including the costs associated with any litigation and damage caused by a violation of the Journal’s and/or PUOL’s reputation and damages arising from any claim, demand, action or proceeding based upon or arising out of the breach or alleged breach of any of the representations or warranties set forth in this Licensing agreement or incurred in the settlement or avoidance of any such claim. This agreement to indemnify shall survive any termination of this Licensing agreement.

2. License grant

2.1. The author hereby grants PUOL a gratuitous royalty-free, non-exclusive, territorially unlimited, transferable, assignable, sub-licensable (also to grant an authorisation forming part of the license) License to use the Work or parts thereof individually or together with other works or elements unlimited as regards to amount and form and media of expression (including electronic) for non-commercial or commercial purposes gratuitously or for consideration without quantitative limitations.

2.2. The License to use the Work covers all the known manners of use of the Work – especially to, but not limited to, reproduce, publish (alone or in cooperation with other publishers), distribute, transmit, make available or communicate to the public, publicly perform, translate, archive, store, sell, lease or lend.

2.3. By granting the license, the author agrees to include parts or the whole Work both online and offline in all forms and media in its initial or adapted form or otherwise modified, whether separately or in a collection or connection with any other works or elements into database, index and distribute via international scientific services and databases (including, but not limited to CrossRef, Directory of Open Access Journals, EBSCO, ERIH PLUS, Google Scholar, Index Copernicus, Scopus, Web of Science - Emerging Sources Citation Index and further relevant scientific databases and services) as well as information systems for providing the informational services, where the Journal is currently indexed as well as those, where it will be indexed pro futuro.

2.3 The License is granted for the duration of economic rights to the Work.

2.4. PUOL shall be not obliged to make use of the license.

3. Further use of Work by the Autor

3.1. Given granted the non-exclusive license to the Work, the author shall be entitled to further use the Work. For the purpose of such further use of the Work, the author shall be obliged to state the Journal as the source of publication of the Work and provide link to its formal publication via its Digital Object Identifier (DOI).

3.2 In the case of disclosure of the Work on the platforms of standard scientific pre-submission communications within the meaning of Art. 1.1, the author shall be obliged to additionally state the Journal as the source of publication of the Work, without undue delay.

3.3 The reputation of PUOL and shall not be the Journal negatively affected by the further use of the Work.

4. Varia

4.1 This agreement shall be governed by and shall be construed in accordance with the laws of Czech Republic. The Czech courts shall have the exclusive jurisdiction.

4.2 This Licensing agreement is effective as of the date of Your submission of the Work into the Journal. If the Work is rejected for publication in the Journal, the license shall be, at the moment of the decision of rejection, restricted in such a way that it shall cover use of Work only in the necessary extent within related editorial activities (e.g. review and archiving).

Open access policy and the consequences

The Journal adheres the Open Access policy and publishes contributions in the “Libre Open Access” mode, under the terms of Creative Commons CC BY-SA 4.0 International (full text available at: http://creativecommons.org/licenses/by-sa/4.0/legalcode (“CC BY-SA 4.0 International”).

Information about CC BY-SA 4.0 International

CC BY-SA 4.0 International are publicly available license conditions that enables a free use of a licensed work under certain conditions. These conditions must be met - in case of non-compliance the user infringes the copyright. CC BY-SA 4.0 International thus sets certain rights and obligations for the public user.

CC BY-SA 4.0 International allows users to "share" the work, which means to provide material to the public by any means or process, such as reproduction, public display, public performance, distribution, dissemination, communication, or importation, and to make material available to the public including in ways that members of the public may access the material from a place and at a time individually chosen by them. At the same time, the work can be included in a collective work (eg. a journal, collection) or modified - changed or supplemented. It also allows you to process all or part of the licensed work with another work (subject of protection) - (creatively modify, modify and create new works from it). Persons other than the rights holder may also commercialize the works made available under the license terms of CC BY-SA 4.0 International. However, the payment is not provided for the right to use the work (it is always available under CC BY-SA 4.0 International), but, for example, for added services or media.

CC BY-SA 4.0 International requires the user's obligations to state and retain the origin of the work (ie title, author, source and reference to the license) and to make available and share the work created by processing the original work under the same license terms like original work. Similarly, the use of the original work without its processing does not requires to license the new work in which the original work was used under the same license conditions. However, the copyright mechanism of the new work does not affect the original work made available under CC BY-SA 4.0 International.

CC BY-SA 4.0 International do not restrict in any way limitations and exceptions to copyright, especially quotation right. Quotation of excerpts of works made available under these license terms does not create an obligation for the quoting user to make available the work in which the quotation was used under the same license terms.

CC BY-SA 4.0 International apply exclusively to the licensed work. It is possible that certain parts of the work are already used under conditions of licenses with third party or limitations and exceptions to copyright. These parts cannot be licensed under the conditions of CC BY-SA 4.0 International.

CC BY-SA 4.0 International do not exclude copyright protection, claims arising from copyright infringement or the realization of moral and economic rights of the author of the work.
